Trademarks means marks that shall be used for the purpose of trade. Trademark means a mark that can be used to portray the business of a proprietor and which can be capable of differentiating between the goods or services of one person from that of the other. In order to file a trademark it is advisable that the owner must conduct a search. Search assures whether the mark is safe to take or not. Earlier the procedure concerning search was very technical but now with new notification governing the same trademark can be searched online free of cost. Once the mark gets through than the next procees is to file the trademark as early as possible so that no one else can claim ownership over the same.
In India a trademark can be filed initially with the help of some basic information. However the information must match with the documents which has to be provided at the later stage of registration. The forms that are required for filing a simple trademark services application are TM-1 (three copies) and Additional Represenation (two copies, may vary from state to state). The government fees for filing trademark application is Rs 3,500 . It is to be noted that for filing one mark in one class the charges of the government is Rs 3,500. A trademark is valid for a period of ten years and after that it can be kept alive for every ten years subject to payment of renewal.
