An application for trademark is scrutinized and examined at the Indian Trademarks Registry. The Trademarks Registry of India is under the control of Government of India, Ministry of Commerce. For the convenience of general people, the Trademarks Registry has established their trademark offices at different places of India. The Head office of Trademarks Registry is situated at Mumbai whereas the rest of the trademark offices are located at New-Delhi, Chennai, Kolkata and Ahmadabad respectively.
A trademark application will not be accepted at any other Registry other than the one which has been specified by the government in respect of the same. For instance applications from the state of Madhya Pradesh, Maharashtra and Goa are filed in Mumbai, applications from State of Jammu and Kashmir, Punjab, Haryana, Uttar Pradesh, Himachal Pradesh, Union Territory of Delhi and Chandigarh are filed in Delhi, applications from the State of Arunachal Pradesh, Assam, Bihar, Orissa, West Bengal, Manipur, Mizoram, Meghalaya, Sikkim, Tripura and Union Territory of Nagaland, Andaman & Nicobar Island are filed in Kolkata, applications from The state of Andhra Pradesh, Kerala, Tamil Nadu, Karnataka and Union Territory of Pondicherry and Lakshadweep Island are filed in Chennai whereas the applications from The state of Gujarat and Rajasthan and Union Territory of Damman, Diu, Dadra and Nagar Haveli are filed at Ahmadabad.
The Trademarks Registry in Mumbai will not accept an application from New Delhi and vice-versa. Thus, before filing a trademark application once should ascertain the place of Registry or else his time and priority of date will be affected.
